POLICIES FOR CUSTOMER
PLATFORM TERMS OF USE
This document is a legally binding agreement that becomes effective upon your acceptance (either
directly or indirectly in electronic form or by means of an electronic record) and forms part of
the Governing Policies for accessing and using the services pr ovided through the website https://snapcar.in
and the mobile application under the
name and style of “ Snapcar ” (here in after referred to as the “Platform”).
Background
The Platform is owned and operated by Snapcar , a business entity duly registered under
applicable Indian laws, with its principal place of business located in Maharashtra
(hereinafter referred to as “ Snapcar ”, “we”, “us” or “our”, which expression shall, unless
repugnant to the context, include its successors and assigns). This document applies to all
users of the Platform, whether natural persons or legal entities (hereinafter referred to as
“you”, “your”, “ User”, or “Vendor” ,”Host” , as applicable).
Snapcar is a digital intermediary that facilitates interactions between independent vehicle
owners (“Vendors”) and individuals seeking to rent self -drive vehicles (“Users”). Snapcar
merely provides the technology interface for listing and booking vehicles and does not own,
manage, lease, rent, insure, or control any vehicle on the Platform. All rental agreements are
strictly between the Vendor and the User.
These Terms of Use, along with the Snapcar Vendor Terms & Conditions, Privacy Policy, and
other applicable policies and guidelines (collectively referred to as the “Governing Policies”),
constitute the entire agreement between you and Snapcar for your use of the Platform and
any services facilitated through it.
Please read these Terms carefully before registering, listing a vehicle, booking a vehicle, or
otherwise using the Platform. If you do not agree to these Terms or any of the Governing
Policies, you are advised not to use the Platform or avail any services offered through it. By
continuing to use or transact on the Platform, you expressly agree to be bound by the terms
set forth herein and any applicable policies of Snapcar.
Snapcar reserves the right, at its sole discretion, to update, modify, or amend these Terms of
Use at any time. Any such changes shall be effective from the date of publication on the
Platform. It is your responsibility to review these Terms periodically for upda tes. Continued
use of the Platform after any such changes shall be deemed as your acceptance of the
revised Terms. In certain cases, we may require explicit consent before further use of the
Platform.
Subject to your compliance with these Terms and the Governing Policies, Snapcar grants
you
a personal, non -exclusive, non -transferable, limited license to access and use the Platform
solely for purposes permitted under these Terms. By accepting these Terms of Use, you also
agree to be bound by all other applicable policies and conditi ons issued by Snapcar from
time to time.
Your Account and Registration Obligations
Eligibility
Only natural individuals or legal entities who are competent to contract under applicable
Indian laws may register and use the Snapcar Platform. By registering, you confirm that you
are legally eligible to enter into binding agreements. Snapcar reserves the right to suspend
or terminate your access to the Platform if it is found or reasonably suspected that you are
not legally competent to contract, or if any information provided by you is misleading or
unlawful.
User Information
If you register and use the Platform, you are solely responsible for maintaining the
confidentiality of your account credentials, including your User ID and password. You shall
be responsible for all activities conducted under your account.
By registering, you agree to:
- Provide true, accurate, complete, and current information as requested during the
registration process.
- Update such information as and when required to maintain its accuracy.
If any information you provide is found to be false, misleading, incomplete, or outdated, or if
you are found attempting to access the Platform through fraudulent means, Snapcar
reserves the right to suspend, block, or permanently terminate your access to the Platform
without notice.
Account Usage and Responsibility
You understand and agree that your account is personal to you and should not be accessed
or used by any third party. Sharing your login credentials or allowing others to transact on
your behalf through your Snapcar account is strictly prohibited.
If you allow any third party to access your account, you will be solely responsible for any
misuse, loss, damage, or liability resulting from such unauthorized use. You further agree to
indemnify Snapcar and other affected Users for any damages, legal consequences, or
liabilities arising from such use.
Snapcar reserves the right to take appropriate legal or administrative action against misuse
of the Platform, including reporting violations to relevant authorities, under applicable
Indian law.
Fees and Taxes
As a User, you are responsible for paying any applicable fees or charges associated with the
use of the Snapcar Platform, including token/advance payments made while booking a
vehicle. You also agree to bear all applicable taxes, duties, cesses, or government-imposed
charges as per Indian law. Snapcar does not control or interfere in any pricing, tax, or
commercial decisions made by Vendors listing their vehicles.
Use of the Platform
By using the Snapcar Platform, you agree, undertake, and confirm that your usage shall be in
strict compliance with the following terms:
- User Responsibility:
You are solely responsible for the accuracy and legality of any information or
documents submitted by you (e.g., Driving License, ID proofs). The Platform
functions
solely as a passive technology facilitator and does not verify the authenticity
of Usergenerated content unless required by law or internal policy.
- Authenticity of Information:
You must not upload, share, or submit any false, misleading, fraudulent, or
impersonated documents or information. This includes using identification
documents that do not belong to you or submitting unauthorized or unverified
data.
- Account Ownership:
Your Snapcar account is personal to you. You shall not assign, transfer, or share
your
login credentials or allow anyone else to book a vehicle using your account.
- Compliance with Laws:
You shall not use the Platform or the booked vehicle in any manner that violates
applicable Indian laws, including the Motor Vehicles Act, traffic rules, or
criminal
laws.
- Prohibited Content and Activities:
You agree not to post, transmit, or engage in any of the following through the
Platform:

Content that is obscene, defamatory, harassing, pornographic, racist,
hateful,
or unlawful in any way.

Activities that promote or relate to money laundering, gambling,
impersonation, identity theft, or exploitation of minors.

Any threatening, abusive, or indecent representation of women or
communities.
- Intellectual Property Protection:
You shall not infringe upon any intellectual property rights of Snapcar or any of its
service providers, Vendors, or technology partners, including copyrights,
trademarks,
or trade secrets.
- Malware or Code Injection:
You must not upload or introduce any viruses, malware, bots, or harmful code that
could interfere with or damage the Platform, its users, or associated services.
- Illegal Use of Vehicle or Platform:
You shall not use the Platform or any vehicle booked through it to transport
prohibited goods, engage in unauthorized activities, or violate any applicable
regulatory or traffic rules.
- Disruption or Liability:
You agree not to take any action that may cause damage, downtime, or loss of
service for Snapcar, its Vendors, or other
- External Listings:
You shall not attempt to redirect traffic, promote, or link to any external platform,
service, or listing that is restricted under Indian law or violates Snapcar’
Governing
Policies.
Violation of any of the above terms may result in immediate suspension or termination of
your account and may also attract civil or criminal liability under applicable laws.
Privacy
Snapcar collects, stores, processes, and uses your personal information in accordance with
its Privacy Policy and the applicable provisions under the Information Technology
(Reasonable Security Practices and Procedures and Sensitive Personal Data or Information)
Rules, 2011.
By using the Platform and/or by voluntarily providing your information, you consent to the
collection, processing, and use of your data as outlined in the Privacy Policy. This includes
the use of your information for identity verification, booking facilita tion, payment
processing, communication, and compliance with applicable legal obligations.
You are encouraged to review the Privacy Policy in full before using the Platform or
submitting any personal information. Continued use of the Platform shall be deemed
acceptance of the terms stated therein.
Payment Facility
Snapcar may, either directly or through its authorized technology and payment partners,
engage third -party payment service providers (such as payment gateways, banks, or
aggregators) in accordance with applicable Indian laws to facilitate payment collection
betwe en Users (customers) and Vendors (vehicle owners).
These third -party payment services may include credit/debit card processors, UPI gateways,
mobile wallets, or other RBI -authorized instruments used for advance/token payments
made through the Platform. The final balance payable is settled directly between the User
and Vendor at the time of vehicle pickup or handover, unless otherwise specified.
Snapcar does not store your payment information on its servers and is not liable for any
payment failures, gateway errors, or processing delays caused by these external providers.
Any issues or disputes related to payments must be addressed directly with the resp ective
payment service provider.
Disclaimers -
- Platform Features & Availability :
The Snapcar Platform may be subject to regular updates or technical modifications.
Certain features may be temporarily unavailable or may not function optimally due
to technical limitations or ongoing improvements.
- Accuracy of Information :
While Snapcar endeavors to provide accurate and timely information, data on the
Platform (including vehicle listings, pricing, and vendor details) may sometimes
contain errors, omissions, or delays due to input from third parties. You acknowledge
and accept that Snapcar is not responsible for verifying every piece of information
listed on the Platform.
- Third -Party Payment Risks :
Snapcar disclaims all liability arising from unauthorized use of your debit/credit card,
UPI, or other payment method on the Platform. Payment systems are operated by
independent third -party service providers, and their actions are beyond our control.
- Third -Party Services Disclaimer :
Snapcar may provide access to third -party tools, payment gateways, verification APIs,
or insurance providers for your convenience. However, Snapcar does not endorse,
guarantee, or take responsibility for the performance, accuracy, or safety of any
third -party services accessed through the Platform. You are advised to make
independent evaluations before relying on any third -party service.
- No Endorsement or Warranty :
Snapcar does not guarantee the quality, safety, or condition of any vehicle, nor does
it certify or endorse any Vendor. The Platform is provided on an "as -is" and "as -
available" basis. Any reliance on vehicle information, vendor communications, or
rental terms is solely at your own risk.
- No Professional Advice :
All content and communication on the Platform is intended for general use only.
Snapcar makes no warranties regarding professional qualifications, mechanical
standards, or operational accuracy of vehicles. You are responsible for performing
your own due diligence before completing a rental.
- Limitation of Liability :
Under no circumstances shall Snapcar , its officers, employees, affiliates, or
technology partners be liable to you or any third party for:
- Personal injury, accident, or wrongful death arising from the use of any
vehicle.
- Loss of data, profits, or business opportunity.
- Technical failure, service interruption, or delays caused by vendors or third -
party service providers.
- Any damages arising from reliance on inaccurate information listed on the
Platform.
Your sole remedy for dissatisfaction with the Platform is to discontinue its use.
Intellectual Property
All intellectual property rights in and to the Snapcar Platform —including but not limited to
its name, logo, design elements, interface, layout, source code, graphics, text, and other
content —are either solely owned by or legally licensed to Snapcar . These assets are
protected under applicable Indian intellectual property laws.
You agree that:
- You will not copy, reproduce, download, republish, transmit, or commercially exploit
any part of the Platform without prior written authorization from Snapcar .
- You shall not attempt to register, use, or imitate the Snapcar name, logo, trademarks,
or any derivative branding in any form or medium.
- If you become aware of any infringement or misuse of Snapcar ’ intellectual property,
you are required to notify us immediately with relevant evidence.
Unauthorized use of Platform content or materials will result in immediate termination of
access and may lead to legal action. In such cases, you must return or destroy any material
you have copied, printed, or downloaded in violation of these Terms.
Indemnity and Limitation of Liability
As a User, you agree to fully indemnify and hold harmless Snapcar , its directors, officers,
employees, affiliates, and technology partners from and against any claims, demands, losses,
liabilities, legal actions, penalties, or expenses (including reasonable legal fees) arising out
of:
- Your violation of these Terms of Use or any Governing Policy;
- Your breach of applicable Indian laws or third -party rights;
- Any misuse of the Platform or a vehicle booked through it;
- Any misinformation or unauthorised document usage on your part.
Limitation of Liability :
To the maximum extent permitted by applicable law, Snapcar ’ total liability in connection
with any claim related to a booking or transaction on the Platform shall be limited to the
subscription fee or token amount (if any) paid to Snapcar in relation to the specific disputed
booking. Snapcar shall not be liable for any incidental, indirect, punitive, or consequential
damages, including:
- Personal injury, theft, or accident during vehicle use;
- Loss of data, business interruption, or profit;
- Service issues caused by Vendors or third -party providers.
General Terms
These Terms of Use represent the entire agreement between you (the User) and Snapcar
with respect to your access and use of the Platform.
- If any clause of these Terms is deemed invalid or unenforceable under law, the
remainder of the Terms shall remain valid and in effect.
- Snapcar may assign or transfer its rights and obligations under these Terms without
prior notice. You may not assign, license, or transfer your rights or account to any
third party without written consent.
- Snapcar may, at its sole discretion, update these Terms from time to time. You are
encouraged to review them periodically.
User Complaints & Support
If you have any feedback, queries, or complaints regarding your experience with the
Platform or services offered by Snapcar , please reach out to our Customer Support team .
We are committed to resolving genuine concerns in a fair and timely manner.
Governing Law and Dispute Resolution
These Terms of Use, along with the Governing Policies of Snapcar , shall be governed by and
construed in accordance with the laws of India.
Any dispute, controversy, or claim arising out of or relating to the use of the Snapcar
Platform, including but not limited to its interpretation, validity, performance, or
termination, shall be subject to the exclusive jurisdiction of the competent courts located in
Mumbai, Maharashtra .
By using the Platform, you agree to submit to the jurisdiction of such courts and waive any
objections to such venue, including those based on jurisdiction or inconvenience of forum.
Terms And Conditions for Host and Guest
Welcome to Snapcar
Welcome to Snapcar , a digital platform accessible at www. Snapcar .com (the “Website”) and
through our official mobile application (the “App”) (together, the “Platform”). The Platform is
owned and operated by Snapcar , a business entity registered under the applicable laws of
India, with its principal place of business in the state of Maharashtra (hereinafter referred to
as “Snapcar ”, “we,” “us,” or “our”).
Snapcar operates solely as a technology intermediary , enabling independent vehicle owners
(“Vendors”) to list their vehicles and allowing customers (“Users” or “you”) to browse, book,
and rent self -drive vehicles directly through the Platform.
Your use of the Platform and any services accessed through it is subject to the following:

- Our Vendor Terms & Conditions
- Any additional policies or guidelines that may be updated from time to time
(together referred to as the “Governing Policies” )
Please read the Governing Policies carefully before registering, booking a vehicle, or
accessing any services. If you do not agree with any part of these policies, you are
advised
not to use the Platform.
By clicking “I Agree,” registering, or continuing to use the Platform, you confirm that
you
have read, understood, and agreed to be bound by the Governing Policies from the date of
such use (the “Effective Date” ).
To improve your experience, the Platform may undergo changes or updates at our sole
discretion, without prior notice. We reserve the right to modify, suspend, or discontinue
any
feature or part of the Platform at any time.
Amendments / Modifications
Snapcar reserves the right to modify, update, or amend the Terms of Use or any part of the
Governing Policies at any time, at its sole discretion. Any changes made will be published on
the Platform with the updated effective date.
Such changes shall become effective immediately upon posting on the Platform. It is your
responsibility to periodically review the Terms of Use and other policies to stay informed
about any updates.
By continuing to use the Snapcar Platform and its services after any
modifications are
posted, you acknowledge and agree to be bound by the updated Terms. If you do not agree
to the revised Terms, you must stop using the Platform and its services immediately.
Snapcar Platform Services
Snapcar is a digital marketplace that enables individual vehicle owners (“Vendors”) to list
their vehicles for self -drive rental, and allows users (“Customers” or “Users”) to browse and
book such vehicles for temporary, personal use (“ Snapcar Platform Services”).
Snapcar does not own, lease, operate, manage, insure, or control any vehicle listed on the
Platform. Snapcar merely provides the technology infrastructure to facilitate interactions
between independent Vendors and Users. You acknowledge and agree that Snapcar is not a
party to the rental or usage agreement between the Vendor and the User.
All rental transactions and vehicle usage are governed by the individual terms set by the
Vendor and must be accepted by the User prior to booking. Snapcar does not assume any
responsibility or liability for the condition, safety, roadworthiness, legality, or quality of the
vehicles, nor for the accuracy of listings, timely delivery, completion of bookings, or any
payment disputes between Vendors and Users.
While Snapcar strives to offer a safe and reliable platform, it does not provide any warranty
or guarantee regarding the performance of either party and disclaims all liability arising from
the conduct, misuse, or default of Users or Vendors.
Platform Services Overview
Snapcar Platform Services include:
- 1. A digital marketplace feature (accessible via www. Snapcar .com ) that enables verified
vehicle owners (“Vendors”) and customers (“Users”) to connect for the purpose of
self-drive vehicle rentals ;
- 2. Technology -based facilitation services such as user account management, listing
display, vehicle search and filtering, booking interface, payment token collection, and
communication tools between Vendors and Users;
- 3. Mobile and web -based applications, widgets, and features owned or operated by
Snapcar that help Users access or interact with the Platform across devices.
Snapcar attempts to maintain accurate and up -to-date information across all listings and
service descriptions on the Platform. However, we do not guarantee the accuracy,
completeness, reliability, or availability of any listings, vehicle details, documents,
images,
Vendor -supplied information, or platform features at all times.
From time to time, the Platform may contain typographical errors, listing inaccuracies,
outdated information, or incorrect availability. Snapcar reserves the right to correct or
update such errors, omissions, or inaccuracies without prior notice , even after a booking
has been placed.
By using the Platform, you agree that Snapcar shall not be held liable for any loss or
inconvenience resulting from inaccurate content, listing mistakes, third -party
misrepresentation, or system -generated errors.
Use of Snapcar Platform Services
While certain sections or features of the Snapcar Platform may be accessible without
registration, to book a self -drive vehicle through Snapcar , you are required to create and
register an account on the Platform.
Only registered Users who meet the applicable eligibility criteria will be permitted to access
and use the booking services offered on the Platform, subject to compliance with the Terms
of Use , Privacy Policy , and other applicable Governing Policies of Snapcar .
Eligibility
The Snapcar Host Services are intended exclusively for individuals or legal entities who are
18 years of age or older and meet the eligibility criteria detailed below. Any attempt to use
the platform without satisfying these requirements is strictly prohibited. Misre presentation
or circumvention of the eligibility criteria may lead to removal from the Platform and may
attract legal action, as applicable.
Host & Vehicle Eligibility Criteria
To list a vehicle as a Host on Snapcar , you must meet the following criteria:
- You must be at least 18 years old and possess a valid government -issued
identification such as Aadhar Card, Passport, or Voter ID.
- You must provide a valid GST registration certificate (if applicable) and have a PAN
card for tax compliance purposes.
- The vehicle must be registered solely in your name or in the name of your business
with proper ownership documentation. Vehicles must be legally permitted for self -
drive use under Indian law.
- The vehicle must be either:
- A private non -transport vehicle registered for personal use, or
- A commercial vehicle registered under the Motor Vehicles Act, 1988 and
compliant with the Rent -a-Cab Scheme, 1989 , with valid self -drive rental
permits.
- The vehicle must have:
- A valid registration certificate (RC)
- Up-to-date road tax receipts and clearances
- No pending insurance claims , legal disputes, e -challans, or unpaid dues at the
time of listing
- The vehicle should be less than 7.5 years old from its date of registration and have
run fewer than 80,000 kilometers .
- It must be clean, well -maintained , and equipped with all standard safety equipment
and accessories as per Snapcar ’ Maintenance and Safety Standards (see Annexure I).
- The vehicle must carry valid third -party comprehensive insurance , as required under
the Motor Vehicles Act, 1988.
- The vehicle must not have been declared a total loss by any insurance company.
- If enrolled under Snapcar ' In-Vehicle Device (IVD) Program , you must have the
device installed and activated before listing the vehicle on the Platform.
Failure to comply with any of the above requirements may lead to rejection of your listing
or
removal from the Snapcar platform.
Guest Eligibility Criteria – Snapcar
To ensure the safety and reliability of all users on the Snapcar platform, customers booking a
vehicle (“Guests”) must meet the following eligibility criteria:
- You must possess a valid driving license issued by a competent authority under the
Government of India. The license must be current and appropriate for the class of
vehicle you intend to drive.
- You must hold a valid government -issued identity document , such as an Aadhar
Card , Passport , or any other officially recognized proof of identity.
- You must not have been involved in any major vehicle accident within the last 12
months.
- You must have:
- No major traffic violations (such as rash driving or signal jumping) in the past
12 months
- No more than two minor traffic infractions (e.g., speeding, parking
violations)
- No record of defaults or history of non-payment or failure to pay fines or
dues related to vehicle usage
- You must have a clean criminal record , which includes no history of:
- Felonies
- Violent crimes
- Theft or burglary
- Offenses involving controlled or prohibited substances
Snapcar reserves the right to verify your eligibility through internal checks or third
-party
services. Failure to meet the above criteria may result in cancellation of your booking or
permanent removal from the platform.
Registering and Creating Your Account – Snapcar
To access and use the Snapcar platform for booking a self -drive rental vehicle, you must first
create an account by providing accurate and complete personal information. Registration
requires a valid email address , creation of a secure password , and submission of relevant
documents to verify your identity and eligibility.
Each user is permitted to maintain only one active account on the Snapcar platform.
Duplicate or fraudulent accounts may result in suspension or permanent deactivation.
Documents Required for Guests (Customers Booking a Car):
To ensure a secure and trustworthy rental experience, the following documents must be
submitted during registration:
- Valid Driving License (issued by the Government of India and appropriate for the
vehicle category)
- Valid Government -issued ID Proof
(Aadhar Card, Voter ID, Passport, etc.)
- Current Address Proof
(Rental Agreement, Utility Bill, or Company Allotment Letter)
- PAN Card (for identity and tax verification purposes)
Snapcar reserves the right to request additional documents, verify submitted information,
or
conduct background checks, if necessary, to maintain platform security and compliance.
Once your documents are verified, your account will be activated, and you can begin
booking vehicles through the Snapcar app or website.
Account Responsibility and Security – Snapcar
Once you have successfully created an account on the Snapcar platform, you are solely
responsible for maintaining the confidentiality of your username, password, and any other
login credentials . You agree to accept full responsibility for all activities that occur under
your account.
If you suspect any unauthorized access , misuse of your account, or breach of security, you
must immediately notify Snapcar by contacting us at: support@ Snapcar .com .
By interacting with the platform or any third -party service providers through Snapcar , you
agree that all the information you provide is true, current, complete, and does not violate
the rights of any third party . Any data or content submitted through the platform is not
considered confidential or proprietary unless explicitly agreed upon otherwise.
Upon registration, Snapcar reserves the right to verify the documents and information
submitted by any user (including Guests and Vendors). We may engage independent third -
party services to perform such verification, and by using the platform, you authorize Snapcar
to request, receive, and store such verification data, in accordance with our Privac y Policy .
Snapcar also reserves the right to suspend or terminate your account at any time, at its sole
discretion, including if we find any discrepancies or violations of our terms or policies.
Additionally, Snapcar may provide relevant user information to vehicle owners (vendors),
insurance companies, or law enforcement authorities if necessary —such as in cases
involving vehicle theft, insurance claims, misuse, or legal investigations .
Important:
Each registered Guest acknowledges and agrees that Snapcar and its affiliates shall not be
held liable for:
- 1. Any unauthorized transactions made using your login credentials.
- 2. Any personal belongings claimed as lost or stolen after the booking period has
ended.
- 3. Any liability you may incur due to misuse of your account by others using your
username or password.
Protect your credentials and always log out of your account on shared or public devices.
Booking Process and Vehicle Availability – Snapcar Guests
Once you have successfully registered on the Snapcar platform, you can browse and book
vehicles listed by verified vehicle owners (“Vendors”) directly through the platform.
Each booking will have a clearly defined start time and end time , referred to as the
“Booking Period” , and a Designated Pickup Location , which will be communicated during
the booking process.
You can create a booking at least 1 hour in advance through the Snapcar app or website. All
bookings must be for a minimum of 24 hours and can extend up to a maximum of 6
months , subject to vehicle availability and Vendor preferences.
Vehicle Pickup Location
All vehicles will be parked at a Designated Location specified by the Vendor. This location
will be clearly mentioned during the booking confirmation. Vendors are required to ensure
that:
- The vehicle is available and accessible at the time of pickup.
- The location is safe, clean, and easily identifiable .
- Directions or access instructions are shared where required (especially in gated
societies or restricted -access areas).
Some Vendors may offer up to two pickup locations within city limits for your convenience.
Rescheduling or Cancellation by the Vendor
While Snapcar encourages reliable bookings, in rare cases, Vendors may cancel or
reschedule a booking. If a Vendor cancels after your booking is confirmed , Snapcar will:
- Notify you immediately,
- Refund the full booking amount if applicable, and
- Provide alternate options where possible.
However, if a Vendor has a pattern of unjustified cancellations , Snapcar may take action
including removing their vehicle listings or suspending their account .
Snapcar strives to offer a seamless and trustworthy experience by enabling direct access to
vehicles owned by individuals and fleet operators, while ensuring that Vendors adhere to
quality and reliability standards.
Online Booking – Snapcar Guest /Customer Terms
Once your account is successfully created and verified on the Snapcar platform, you will
receive a confirmation message or email from Snapcar . After verification, you can browse
through available vehicles listed by various vendors (vehicle owners) and submit booking
requests directly through the platform.
As a Guest (user), you will be able to:
- Book a vehicle to start your trip at any time , based on real -time availability.

When a booking request is submitted for a selected vehicle, Snapcar will confirm
availability
and send you the final booking confirmation , along with all necessary details, via email,
SMS, or in -app notification.
Important Acknowledgements
By making a booking on the Snapcar platform, you acknowledge and agree that:
- 1. You accept the conditions associated with the selected vehicle, as outlined in the
listing.
- 2. You understand that Snapcar acts solely as a technology intermediary and is not a
party to the lease or usage agreement between you and the vendor.
- 3. Any transaction, communication, or agreement between you and the vehicle owner
is conducted at your own discretion and risk .
Snapcar does not own or manage any vehicles listed on the platform and assumes no
responsibility for the vehicle's performance or the conduct of the vendor. However,
Snapcar
may step in to assist with dispute resolution where possible, in accordance with its
support
and safety policies.
Vehicle Ownership – Snapcar Guest /Customer Terms
As a Guest (customer) on the Snapcar platform, you acknowledge and understand that your
booking grants you only temporary usage rights over the selected vehicle. At all times, the
complete legal ownership, possession, and responsibility for the vehicle remains solely
with the Vendor (vehicle owner) who has listed the vehicle on the platform.
This Terms of Use document governs your interaction with the Snapcar platform, while a
separate lease or usage agreement (where applicable) between you and the Vendor will
cover the detailed terms of each booking. That includes but is not limited to:
- Payment of applicable charges or fees
- Responsibility for damages, fines, or violations during your use
- Theft or accident incidents
- Insurance coverage and claims
- Any additional liabilities arising from the use of the vehicle
You acknowledge that Snapcar does not own, manage, operate, or control any of the
vehicles listed on the platform. Snapcar functions purely as a technology intermediary ,
connecting you (the Guest) with independent vehicle owners (Vendors), and is not a party
to
the rental or lease transaction.
Lease of Vehicle – Snapcar Guest Terms
Once a booking is accepted by the Vendor (vehicle owner), the Vendor and Guest (you) will
be required to electronically execute a standard Lease Agreement through the Snapcar
platform. This agreement formalizes the terms and conditions of your booking, including the
applicable commercial terms, and ensures compliance with relevant Indian laws.
Snapcar , as a technology facilitator , will assist both parties in digitally signing and securely
maintaining the Lease Agreement records. Please note that your trip cannot commence
unless this Lease Agreement is successfully executed via the platform.
As a Guest, you acknowledge that:
- The Lease Agreement represents a binding contract directly between you and the
Vendor .
- Snapcar is not a party to this Lease Agreement , nor does it assume any liability or
responsibility arising from it.
- The terms outlined in the Lease Agreement will cover all relevant aspects of the
rental such as:
- Rental charges and fees
- Damage protection fee (if applicable)
- Responsibility for fines or traffic/parking violations
- Theft, accidents, or vehicle confiscation
- Insurance coverage
- Obligations related to the condition, use, and return of the vehicle
- Dispute resolution between you and the Vendor
Both you and the Vendor agree to carefully review the terms of the Lease Agreement before
proceeding. If you are unclear about any aspect of the agreement, you are encouraged to
seek independent legal advice . Snapcar provides the lease execution mechanism solely for
convenience and record -keeping and does not provide legal or contractual guidance .
In case of any inconsistency between the Lease Agreement and the general Terms of Use of
the Snapcar Platform, the Snapcar Terms of Use shall prevail .
Offline Arrangements – Snapcar Guest Policy
Guests and Vendors (vehicle owners) are strictly prohibited from entering into any rental,
lease, or similar arrangements for a listed vehicle outside the Snapcar Platform with the
intent to circumvent the Platform, its fees, or its policies . Any such action, referred to as
“Offline Arrangements,” is considered a direct violation of Snapcar ’ Terms of Use .
These prohibited Offline Arrangements include —but are not limited to —attempts to:
- Book or use a listed vehicle outside of the official Snapcar booking system;
- Bypass payment through the platform to avoid service fees or facilitation charges;
- Avail of platform -based services (such as insurance facilitation, customer support, or
verification) without a valid Snapcar booking.
If a Guest or Vendor proposes or participates in such an Offline Arrangement , it must be
immediately reported to Snapcar . Failure to do so may result in the following actions:
- Suspension or permanent termination of your Snapcar account
- Restrictions on future bookings or listings
- Financial penalties, including application of Facilitation Fees
- Legal action or recovery of enforcement costs
Important: Any Offline Arrangement will not be eligible for the protections or services
offered by Snapcar , including but not limited to dispute resolution . Snapcar bears no
liability —direct or indirect —for any issues, losses, damages, or legal claims arising from
such
unauthorized agreements.
To ensure trust, safety, and transparency on the platform, all bookings and transactions
must be made through the Snapcar system only .
Vehicle Delivery – Snapcar Guest Policy
Once the Lease Agreement has been successfully executed, the vehicle Vendor (Host) shall
ensure the following before delivery:
- The vehicle will be thoroughly cleaned, sanitized , and kept ready for handover,
including routine servicing and maintenance , in compliance with Snapcar ’
maintenance and safety standards (refer to Annexure I).
- The vehicle will be delivered along with original documentation , including the
Registration Certificate, Insurance Policy, Pollution Under Control (PUC) Certificate,
and any other documents required under applicable laws (collectively referred to as
“Vehicle Documentation”).
- The vehicle must be made available at the Designated Pickup Location at the
scheduled time .
- If the Guest has opted for home delivery , and the Vendor has agreed to it, the
vehicle will be delivered to the Guest’s address. In such cases, the Vendor is
responsible for safe and timely delivery . Any damage incurred in transit will be the
Vendor’s responsibility , and repairs must be covered under their own insurance
policy .
Guest Responsibilities at Delivery:
- The Guest must be physically present to receive the vehicle and sign off on the
handover.
- Before accepting delivery, the Guest must inspect the vehicle for any issues related
to cleanliness, functionality, or safety.
- Once delivery is accepted, it will be deemed that the Guest has found the vehicle to
be in good condition and fit for use .
- Any concerns or faults identified after delivery will be handled in accordance with
the terms of the Lease Agreement between y ou and vendor.
For a smooth experience, Snapcar encourages Guests to carefully review the vehicle and
documents before driving off.
Cancellation or Shortening of Booking – Snapcar Guest Policy
If you (the Guest) wish to cancel your booking or shorten the reserved booking period , you
must do so in advance and in accordance with the Snapcar Fee Policy .
If you are unable or unwilling to accept delivery of the vehicle at the agreed time and
location —for any reason —your booking will be considered automatically cancelled , and
any advance Lease Rental paid will be forfeited . This forfeiture is to compensate the Vendor
(Host) for time, resources, and costs incurred in preparing the vehicle for your use.
Please note:
- Refunds (if any) will be subject to the timing of cancellation and terms outlined in
the Fee Policy.
- Snapcar is a technology platform facilitating the connection between Hosts and
Guests. Therefore, if you face any loss due to delays, failed delivery, or non -
availability of the vehicle , Snapcar will not be liable for such losses. The
responsibility rests with the respective Host, as per the Lease Agreement.
For a hassle -free experience, we recommend planning your booking carefully and notifying
us as early as possible for any changes.
Terms of Vehicle Use
The vehicle booked through the Snapcar platform shall be driven only by the registered User
(Guest) and used in a responsible and lawful manner, solely for personal use, and strictly
within the geographic area specified in the Vendor’s rental terms (“Permitted Territory”).
The use of the vehic le must comply with all applicable Indian laws and the conditions set
forth by the Vendor in their individual rental agreement (“Permitted Use”).
Any usage of the vehicle beyond the Permitted Use, including but not limited to usage by
unauthorized drivers or for unlawful or commercial purposes, is strictly prohibited
(“Prohibited Uses”). Such misuse may result in the immediate termination of the boo king
without notice and may lead to penalties or legal action by the Vendor.
The User shall be fully liable for any intentional or negligent damage caused to the vehicle
during the booking period, whether caused by the User personally or by any person allowed
by the User to drive the vehicle. The User is also responsible for ensuri ng compliance with all
Vendor -specified restrictions throughout the rental duration.
FACILITATION FEE, PLATFORM FEE, DAMAGE PROTECTION (IF ANY), AND LEASE RENTAL
STRUCTURE – SNAPCAR
- 1. Facilitation Fee (For Vendors):
Snapcar is entitled to charge the Vendor a Facilitation Fee for providing technology,
platform
access, and listing visibility. This fee is based on a fixed subscription model or platform
-
defined service charges and may vary as per the applicable Vendor Fee Policy. The
Facilitation Fee (if applicable) will be deducted from the advance amount before it is
transferred to the Vendor post successful trip completion.
- 2. Platform Fee (For Users):
At the time of booking, the User shall pay a Platform Fee , calculated as a small
percentage
or fixed charge over the booking value. This fee is charged towards platform services
including booking management, customer support, payment gateway handling, and dispute
facilitation.

- 3. Lease Rental and Payment Flow:
For Users:
- The User is required to pay a token/advance amount through the Snapcar Platform
at the time of booking.
- The remaining amount is paid directly to the Vendor at vehicle pickup , as per the
Vendor’s terms.
- The advance amount is transferred to the Vendor after successful completion of the
trip, post deduction of any applicable platform fees or penalties.
For Vendors:
- Vendors will receive the Lease Rental (advance) paid by the User, after deducting the
applicable platform or facilitation charges.
- Payouts will be settled within 14 –24 hours after successful trip completion.
- Weekly reconciliation of adjustments, refunds, or penalties (if any) will occur, with
disbursals for completed trips by the next working day.
If a Vendor fails to honor a confirmed booking, they may be liable to a penalty of up to
50%
of the booking value, depending on severity and frequency of violation.
- 5. Additional Charges and Penalties (for Users):
Users may be liable to pay additional charges in the following cases, as per the Vendor’s
listing or applicable Fee Policy:
- Add-on services (if availed): e.g., home delivery, additional driver, etc.
- Booking -related penalties : Late returns, drop -off at incorrect location, cancellations
or rescheduling outside the allowed window.
- Loss or damages : Including lost keys, documents, unpaid tolls, traffic violations, or
accident -related repairs not covered under protection plans.
- Misuse or Prohibited Use : Deliberate misuse of vehicle or violations of agreed terms
may lead to full liability and possible legal action.
The User authorizes Snapcar to recover or offset any due amounts from pending payouts or
future bookings in case of such occurrences.
- 6. Payment Failures and Restrictions:
- In the event of failed payments, returned UPI/cheque transactions, or chargebacks,
Snapcar may charge administrative or processing fees .
- Users may be restricted from making future bookings until all outstanding dues are
cleared in full.
- The User is responsible for any collection costs , including third -party collection
agency charges, legal fees, or other recovery expenses.
- 7. Responsibility for Payment Details and Tax Compliance:
- Both Users and Vendors are solely responsible for maintaining accurate payment,
bank, and tax information (including PAN/GST if applicable) on their account.
- Snapcar shall not be liable for payment delays or errors arising from incorrect details
provided by either party.
- Vendors are fully responsible for compliance with applicable tax laws , including GST
registration and collection. In case any tax -related liability falls on Snapcar due to a
Vendor’s default, Snapcar reserves the right to recover such amounts from the
Vendor.
- 8. Dispute Window:
- All disputes related to a booking must be raised within 15 days of trip completion.
- Exceptions may be granted up to 90 days only for select categories such as:
- Traffic violations
- Vehicle damage
- Inconvenience charges
- Outstanding fee disputes
After this period, no complaints will be entertained by the platform.
- 9. Snapcar – Payments and Fee Policy (For Users)

This Payments and Fee Policy (“Policy”) governs the payment structure, fees, charges, and
refund process applicable to Users (“Guests” or “You”) who book self -drive vehicles via
the
Snapcar platform (mobile app and/or website). By booking a vehicle, you agree to comply
with the terms stated herein.
- 1. Booking & Payment Flow
1.1 Token/Advance Payment
- At the time of booking, Users are required to pay a token or advance amount
through the Snapcar platform to confirm the reservation.
- This amount may vary based on the vehicle type, rental duration, and Vendor
pricing.
1.2 Balance Payment
- The remaining Lease Rental amount must be paid directly to the Vendor (vehicle
owner) at the time of vehicle pickup.
- The payment mode for balance can be agreed upon between the User and the
Vendor (cash, UPI, transfer, etc.).
1.3 Payout to Vendor
- The token/advance amount paid at the time of booking will be transferred to the
Vendor post successful trip completion, after deducting any applicable platform
charges or penalties.
- 2. Fee Components
2.1 Lease Rental
- The full rental amount (token + balance) paid by the User is referred to as the Lease
Rental.
- This fee includes:
- Rental for the selected duration and vehicle.
- Applicable taxes (if any) as included by the Vendor.
2.2 Platform Fee
- A Platform Fee is charged on every booking to cover platform usage, support
services, verification processes, and operational handling.
- It is calculated as a fixed amount or a percentage of the Lease Rental, depending on
the booking value.
- 3. Additional Charges (if applicable)
You may be charged additional fees as applicable under the Vendor’s rental terms or in the
event of specific incidents:

Snapcar reserves the right to adjust future booking credits or withhold refunds if there
are
pending dues from the User.
- 5. Cancellation and No -Show Policy

Refunds may take 5 –7 business days to reflect.
- 6. Dues & Booking Restrictions
- If you have any outstanding payments, your Snapcar account may be temporarily
restricted from future bookings.
- Snapcar reserves the right to recover unpaid dues via deductions from upcoming
refunds or legal recovery channels, including collection agencies and legal notices.
- In case of repeated misuse or violations, the User may be blacklisted from the
platform.
- 7. Tax Responsibility
- Vendors are solely responsible for complying with GST or other applicable taxes on
their earnings.
- Snapcar is not liable for any tax -related disputes between Users and Vendors.
- If required by law or a government authority, Snapcar may share your
booking/payment details for compliance purposes.
- 8. Dispute Resolution Timeline
- Disputes must be raised within 15 days of booking completion.
- For specific disputes (e.g., traffic fines, damages, penalties), Users may raise a
complaint within 90 days.
- No claims will be entertained beyond these timelines unless legally required.
- 9. General Terms
- Snapcar is a technology platform and not a vehicle operator. All rental terms,
pricing, and liabilities are defined and enforced by the respective Vendors.
- In case of discrepancies between this Policy and any Vendor -specific terms, this
Policy shall prevail for matters involving platform -level services and payments.

Guest’s Obligations – Snapcar Users
All Users (“Guests”) booking vehicles through the Snapcar platform are required to comply
with the applicable rental terms defined by the Vendor (Host) throughout the duration of
the booking period, including until the vehicle is returned to the Host in good working
condition.
In addition to any Vendor -specific terms, the Guest agrees to the following obligations:
- 1. Vehicle Maintenance & Care:
- The Guest shall, at their own expense, maintain the cleanliness, operational
condition, and external appearance of the vehicle during the booking.
- The vehicle must be returned in a condition similar to that at the time of
pickup, allowing for normal and reasonable use.
- 2. Permitted Usage Only:
- The Guest agrees to use the vehicle solely for the permitted purposes as
defined in the Vendor’s terms .
- The Guest shall exercise the same degree of caution and responsibility as if
the vehicle were their own.
- Any Prohibited Use, including misuse, reckless driving, unauthorized drivers,
or illegal activities, is strictly forbidden and may lead to penalties or legal
action.
- 3. Vehicle Documentation:
- The Guest is responsible for ensuring that all Vehicle Documents (such as
Registration Certificate, Insurance, PUC, etc.) provided by the Host remain in
the vehicle and are safely maintained.
- In case any document is lost or stolen during the booking, the Guest shall
bear the full cost of obtaining duplicates, along with any associated
damages or penalties as applicable under the Vendor’s terms.
The Guest further acknowledges that failure to meet the above obligations may result in
additional charges, deductions from the booking amount, restrictions on future bookings,
or legal action, depending on the severity of the breach.
- 4. Pre-Trip Condition Check & Vehicle Eligibility
- Before starting the trip , the Guest must:
- Inspect the vehicle for any pre -existing damages, functional issues, or
irregularities.
- Notify the Vendor immediately of any such findings.
- Log the same in the Snapcar platform through the app’s pre -trip photo
upload or reporting feature.
- The Guest must also verify that:
- The vehicle provided by the Vendor is legally eligible and compliant for self -
drive rental under the applicable Rent -a-Cab permit or licensing norms .
- If the vehicle does not meet eligibility or safety standards , the Guest should
refuse to start the trip , request a replacement through the Snapcar
platform , and report the issue immediately via the in -app complaint
mechanism.
Trip End and Extension Guidelines
At the End of the Trip – Mandatory Steps
Before handing over the car:
- 1. Fill the "Booking End/Drop Checklist" in the app with updated photos showing the
vehicle's final condition.
- 2. Return all items (keys, documents, accessories) to the Vendor.
- 3. Make sure the vehicle is returned to the designated return point and at the
scheduled time .
If Extending the Trip
- 1. Use the Snapcar app to extend the booking officially. Do not exceed the booking
duration without updating it on the platform.
- 2. If extension is not possible due to vehicle availability or system restrictions, return
the vehicle as originally scheduled to avoid penalties.
- 3. Unauthorized usage beyond the scheduled return time may lead to:
- Late return charges
- Temporary platform suspension
- Liability for any incidents occurring after the booking expiry
Warranties of the Parties – Snapcar
This section outlines the representations and warranties made
by both Hosts (Vendors) and
Guests (Users) while using the Snapcar platform. By registering and entering into rental
agreements via Snapcar , all parties confirm their compliance with the following:
Vendor (Host) Warranties:
Each Host listing a vehicle on the Snapcar platform represents and warrants that:
- 1. The Host is the sole legal, beneficial, and registered owner of the vehicle(s) listed on
the Snapcar platform or is fully authorized to rent the vehicle on behalf of the legal
owner.
- 2. The vehicle listed:
- Is in roadworthy, safe, and sound condition , and free from any known
defects or faults that may impair its safe operation under normal use.
- Complies with all eligibility requirements , fitness certifications, and
registration norms required for self-drive rental under applicable laws in
India.
- 3. The Host has the legal right, authority, and capacity to enter into and be bound by
all agreements associated with the Snapcar platform, including the Vendor Terms ,
User Lease Agreement , and other Platform Policies .
- 4. There are no ongoing legal actions, investigations, claims, or proceedings from any
government authority, third party, or regulatory body that may affect or prohibit:
- The listing of the vehicle on the platform,
- The lawful rental of the vehicle to Users, or
- The fulfillment of obligations under the booking.
Guest (User) Warranties:
Each User (Guest) booking a vehicle through the Snapcar platform represents and warrants
that:
- 1. The Guest is above the minimum legal driving age as prescribed under Indian Motor
Vehicle laws and holds a valid, active driving license that authorizes them to drive
the class of vehicle being booked.
- 2. The Guest has the full legal authority and contractual capacity to enter into and
fulfill the terms of the Rental Agreement with the Host , and is fully bound by all
applicable Snapcar Platform Policies .
- 3. There are no pending legal proceedings, restrictions, or regulatory actions that may
affect the Guest’s ability to:
- Lawfully operate a motor vehicle,
- Enter into a rental transaction, or
- Comply with the obligations outlined in the Lease Agreement and platform
terms.
Platform Warranties and Disclaimers – Snapcar
The Snapcar platform and associated services are provided to Users and Vendors strictly on
an “as-is” and “as -available” basis . Snapcar makes no express or implied representations or
warranties regarding the accuracy, reliability, completeness, suitability, or availability of any
content, vehicle listing, or functionality on the Platform.
- 1. No Guarantee on Platform Content or Listings
Snapcar does not verify or guarantee the correctness of:
- Any vehicle description, pricing, availability, or Vendor -provided information.
- Any communication or representations made by Vendors or other Users.
You acknowledge that your use or reliance on any content or listing available through the
Platform is entirely at your own risk. Snapcar shall not be liable for any loss, damage,
or
inconvenience resulting from such reliance.
- 2. Availability and Interruptions
Your ability to access and use the Snapcar platform may be interrupted due to factors
outside our reasonable control, including but not limited to:
- Internet outages
- Telecommunication failures
- Technical maintenance
- Platform upgrades or emergency repairs
Snapcar does not guarantee uninterrupted or error -free operation of the Platform and
shall
not be responsible for any inability to access or use services caused by such disruptions.
- 3. Changes to Platform Features
Snapcar reserves the right to modify, suspend, or discontinue any aspect of the Platform
at
any time, including:
- Features or functionalities
- Categories or availability of listings
- Content formats or operating hours
Such changes may occur without prior notice. Snapcar shall not be liable for any loss or
inconvenience arising from these updates.
- 4. Information Provided via Support, Email, or Social Media
Any advice, suggestions, responses, or information provided by Snapcar (including its
employees or representatives) through:
- Platform chat
- Customer support calls/emails
- Social media channels
- Informational content

as to the completeness, applicability, or reliability of such communications. Users relying

this information do so entirely at their own discretion and risk.
Under no circumstances shall Snapcar , its employees, agents, or affiliates be held liable for:
- Any outcomes resulting from reliance on such information
- Any damages or losses arising therefrom
By using the Snapcar platform, you acknowledge and agree to these limitations and
disclaimers as part of the Platform Terms of Use.
User Indemnities – Snapcar
By accessing and using the Snapcar platform, and by entering into a rental agreement with a
Vendor (Host), the User (“Guest”) agrees to indemnify and hold harmless Snapcar , its
affiliates, directors, officers, employees, representatives, agents, licensors, successors, and
assigns (collectively referred to as the “Snapcar Group” ) from and against any and all losses,
liabilities, claims, damages, costs, and expenses (including reasonable attorney fees and
litigation costs), arising out of or related to the following:
- 1. Breach of Agreement or Policy
- Any breach by the Guest of the Lease Agreement , Snapcar Terms of Use , or other
applicable Platform Policies , including inaccurate or false representations made by
the Guest during account registration, booking, or usage.
- 2. Misuse or Illegal Use of Vehicle
- Any liability, loss, damage, injury, or legal claim arising from:
- Unauthorized, negligent, reckless, or malicious use of the rented vehicle.
- Any third -party injury, death, or property damage caused during the use of
the vehicle.
- Use of the vehicle outside the Permitted Territory or in violation of Indian
motor vehicle laws.
- 3. Violation of Representations & Warranties
- Any claims or losses arising from false or misleading information provided by the
Guest, including invalid driving license, impersonation, or misrepresentation of
eligibility or purpose of use.
- 4. Third -Party Tools, Social Media & Content
- Any liabilities incurred due to:
- Use of third -party tools or integrations accessed via the platform.
- Use of services that interact with social media or external websites.
- Content posted or transmitted by the Guest (or someone using their account)
that violates applicable laws, third -party rights, or platform terms.
- 5. Inter -User Disputes
- Any dispute, claim, or legal demand arising from the Guest’s direct interactions,
transactions, or communications with a Vendor (Host) or another User on or through
the Snapcar platform.
Ongoing Obligation & Cooperation
Each of the above indemnity obligations is separate, independent , and will continue even
after the termination or expiry of the User’s account or rental transaction.
The Guest also agrees to:
- Cooperate fully and reasonably in the defense of any such claim.
- Allow Snapcar , at its sole discretion and cost, to assume exclusive control and
defense of any matter subject to indemnification.
- Not settle or resolve any such claim without prior written consent from Snapcar .
By using the Snapcar platform, the Guest acknowledges and agrees to these indemnification
obligations as a condition of service.
Termination of Agreement or Booking – Snapcar Users
This Agreement shall remain valid and applicable as long as the User (“Guest”) continues to
access or use the Snapcar platform or services , and until such time it is terminated by either
party in accordance with the terms below.
User -Initiated Termination
You may terminate your use of the Snapcar platform at any time by:
- Ceasing access to the Snapcar website or app.
- Deleting or deactivating your User account, if such an option is available.
- Discontinuing any ongoing or future use of the services.
Note: Termination of your account will not cancel or waive any pending obligations ,
including:
- Payment for active or completed bookings.
- Outstanding fees, penalties, or charges due under platform policies.
Platform -Initiated Termination
Snapcar reserves the right to suspend or terminate your account or access to the platform ,
either:
- By providing 30 (Thirty) days’ prior written notice , or
- Immediately and without prior notice under the following circumstances:
Termination Grounds:
- 1. Legal Requirement : If required by law or on request by a government or law
enforcement authority.
- 2. Commercial Viability : If continued services to the User are deemed unviable by
Snapcar .
- 3. Non -Payment : If you fail to pay dues or charges for more than 15 days after the due
date.
- 4. Breach of Policy : If you violate any term of this Agreement, platform policies, or the
terms of a Lease Agreement with a Vendor.
- 5. Prohibited Use : If the vehicle is found to be used for unauthorized or illegal
purposes .
- 6. Misuse of Platform : If you are found to be misusing the platform, harassing other
users, or attempting to manipulate listings or reviews.
- 7. Discontinuation of Services : If Snapcar discontinues part or all of its services or
platform functionality.
- 8. Technical Failures : In the event of unexpected technical or operational issues that
prevent the platform from functioning.
- 9. Other Circumstances : Any unforeseen or force majeure situation that makes
continued service provision impossible.
Termination of Lease Agreement (Between Guest and Host)
- The Lease Agreement between the Guest and the Vendor (Host) may be terminated
as per the mutually agreed terms defined at the time of booking.
- Snapcar does not own or manage this agreement but provides the technology
infrastructure for its initiation.
Consequences of Termination
Upon the termination of this Agreement or the completion/cancellation of a booking:
- 1. Return of Vehicle :
The Guest must immediately return the vehicle to the Vendor at the designated
drop -off location , following all applicable return and handover guidelines.
- 2. Outstanding Payments :
The Guest must pay any pending Lease Rental , penalties, damages, or charges owed
under the Agreement or Platform Fee Policy.
The Vendor must also clear any dues owed to Snapcar , if applicable.
- 3. Advance Refund :
If the Guest has paid for a longer duration than used (and the trip is shortened or
canceled), any remaining balance may be refunded after:
- Deducting applicable fees, damages, or penalties.
- Verification of vehicle return and condition by the Host.
- 4. Data & Material Cleanup :
Upon termination, you must delete or destroy any digital or downloaded material,
content, or media obtained from Snapcar unless required for recordkeeping, legal, or
tax purposes.
By using the Snapcar platform, you acknowledge and agree that termination —whether
initiated by you or by Snapcar —does not waive your liabilities incurred prior to the date of
termination, and all disputes shall be resolved as per applicable platform policies and Indian
law.
Platform Recommendations
Any suggestions, recommendations, or listings shown to you on the Snapcar platform are
intended solely for your convenience and general informational purposes . These do not
constitute an endorsement or guarantee of any vehicle, Vendor, or service quality by
Snapcar or its affiliates.
You are advised to exercise your own discretion and perform independent verification
before proceeding with a booking. Snapcar shall not be held liable for any decision made by
the User based on such recommendations.
User Content Policy
“User Content” refers to any content submitted, uploaded, posted, shared, or transmitted by
Users on or through the Snapcar platform, including but not limited to:
text, images, photographs, documents, chat messages, audio, video, reviews, or any other
digital material.
You understand and agree that:
- You are solely responsible for the content you share via the Snapcar platform.
- Snapcar does not review or verify User Content , nor does it assume any liability for
its accuracy, quality, or legality.
Prohibited Content
You agree not to post, transmit, or share any content that:
- 1. Violates the rights (including intellectual property rights) of another person or entity.
- 2. Is abusive, harassing, defamatory, vulgar, obscene, hateful, violent , or otherwise
offensive.
- 3. Contains pornographic, racist, discriminatory, or illegal content .
- 4. Is misleading, impersonates another individual, or misrepresents your affiliation.
- 5. Involves or encourages criminal acts, money laundering, or gambling .
- 6. Uploads viruses, malware, or malicious code designed to harm the platform or
users.
- 7. Disrupts or threatens the security, sovereignty, or integrity of India or incites public
disorder.
- 8. Harms or exploits minors in any way.
Platform Rights and Moderation
Snapcar reserves the right (but not the obligation), at its sole discretion, to:
- Remove, modify, or refuse to post any User Content that violates this policy or is
otherwise inappropriate.
- Suspend or terminate accounts found to be in violation of these content rules or
engaged in harmful behavior.
- Enforce content moderation to maintain a safe and compliant user environment .
Snapcar does not guarantee that you will not encounter content that you may find
objectionable. Under no circumstances shall Snapcar be liable for any harm or loss
resulting
from exposure to or use of User Content.
Deleting Your User Content
If you wish to request the removal of User Content you previously submitted (e.g., uploaded
images, reviews, or messages), please email us at:

Your request must include:
- Your full name
- Registered email address on Snapcar
- Username or booking ID
- Description or date(s) of the content you want to delete
- Reason for the request
Please allow up to 45 business days for processing. Snapcar may be unable to act on your
request if insufficient details are provided or if the content is legally required to be
retained
(e.g., for dispute or audit purposes).
Intellectual Property Rights – Snapcar
The name “Snapcar ”, its associated logo , product names , designs , and slogans are the
exclusive trademarks , service marks , or intellectual property (collectively, “Marks”) of
Snapcar Technologies Private Limited . All other brand names or Marks appearing on the
platform are the property of their respective owners.
Nothing contained on the Snapcar platform shall be construed as granting any license or
right to use any Marks displayed herein without the prior written consent of the respective
intellectual property holder. Any unauthorized use of Marks or logos, whether registered or
unregistered, is strictly prohibited and may result in legal action. Snapcar disclaims all
liability for any misuse of third -party Marks by Users or Vendors.
Platform Content and Usage Restrictions
Snapcar , along with its licensors and content providers, expressly retains all rights to:
- Text
- Code
- Software
- Layout and design
- Photographs and videos
- Illustrations, icons, logos, and graphics
- Platform content structure, arrangement, and compilation
The look, feel, and functionality of the Snapcar platform is protected under applicable
Indian copyright laws , design laws , and international treaties . You are granted a
limited,
revocable , non-exclusive , and non-transferable right to use the platform strictly for
personal and non -commercial purposes .
You May Not:
- Copy, reproduce, republish, download, post, transmit, or distribute any content from
the Snapcar platform for commercial use.
- Create derivative works or modify any content without prior written authorization.
- Use any Snapcar branding, logo, or materials for marketing, advertising, or resale.
- Frame or link to any part of the Platform for commercial or misleading purposes.
Any unauthorized use of the platform’s contents or intellectual property will constitute a
violation of this agreement and may result in account suspension, legal proceedings, or
both.
Permitted Use:
You may:
- Download or print content from the platform strictly for personal, informational, or
non-commercial use .
- Create a personal hyperlink to the homepage of Snapcar for informational sharing
purposes, provided it does not damage or misrepresent the platform or its services.
No ownership rights are transferred to you through the act of accessing or downloading
content. All rights not expressly granted herein are reserved by Snapcar and its
licensors.
If you believe any content on the platform infringes on your intellectual property rights,

Disclaimer of Warranty & Limitation of Liability – Snapcar
Platform Use and Vehicle Listings
The Snapcar platform is designed solely to facilitate the discovery and booking of self -drive
rental vehicles between independent vehicle owners (“Vendors/Hosts”) and customers
(“Users/Guests”). Snapcar does not own, operate, manage, control, inspect, insure, or
verify any vehicles listed on the platform.
We do not guarantee the condition, legal compliance, safety, or suitability of any vehicle,
nor the accuracy of any Vendor’s listing. All bookings and rental agreements are made
directly between the Host and the Guest , and are entered into entirely at your own risk .
Snapcar shall not be held responsible or liable for:
- Vehicle -related incidents, theft, damages, or third -party claims, total loss,
- Vendor misrepresentation,
- Disputes arising from a rental agreement or vehicle usage.
Platform Functionality and Content
The Snapcar platform is provided on an “as-is” and “as -available” basis , without any
warranties, either express or implied, unless otherwise required by law. This includes, but is
not limited to, implied warranties of:
- Merchantability,
- Fitness for a particular purpose,
- Accuracy or completeness of content.
Snapcar makes no guarantees that:
- The platform will be free of errors, viruses, bugs, or service interruptions,
- Any specific outcomes or results will be achieved,
- Errors or defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law , Snapcar and its directors, officers, employees,
affiliates, agents, licensors, or partners will not be liable for any direct or indirect loss,
including but not limited to:
- Business interruption or operational downtime
- Access delays or service outages
- Data loss, corruption, or theft
- Damage caused by third -party links or external websites
- Inaccurate content or listings
- Any force majeure or unforeseen circumstance
- Viruses, technical failures, or malicious code
Snapcar shall not be liable for any incidental, special, punitive, or consequential damages

including loss of revenue, profits, goodwill, or business opportunity.

Final Disclaimer

User) and Snapcar , recognizing that Snapcar acts solely as a digital intermediary. These terms
shall survive the termination or expiration of your use of the platform.
Governing Law and Jurisdiction – Snapcar
This Agreement, along with all associated policies and terms of use on the Snapcar platform,
shall be governed by and construed in accordance with the laws of India .
All disputes, controversies, or claims arising out of or relating to:
- This Agreement,
- The interpretation or breach of platform terms,
- Any booking made through the Snapcar platform,
shall be subject to the exclusive jurisdiction of the competent courts located in
Pune, Maharashtra , where Snapcar Technologies Private Limited is headquartered.
Arbitration Clause
In case of any unresolved dispute between the User (Guest) and Snapcar regarding platform
services or terms of this Agreement, the matter shall be referred to arbitration . The
following terms shall apply:
- The dispute shall be settled by a sole independent arbitrator , mutually appointed by
the parties or, failing mutual agreement, appointed in accordance with the provisions
of the Arbitration and Conciliation Act, 1996 , as amended from time to time.
- The seat and venue of arbitration shall be Pune, Maharashtra , and the proceedings
shall be conducted in English ,Hindi or Marathi .
- The decision of the arbitrator shall be final and binding on both parties.
Right to Injunctive Relief
Notwithstanding the above:
Snapcar reserves the right to seek injunctive, interim, or equitable relief from any court of
competent jurisdiction to:
- Protect its intellectual property , trademarks, and confidential information,
- Prevent misuse or infringement of the platform,
- Preserve the status quo pending arbitration.
Platform Security – Snapcar
For the safety and integrity of all users, you are strictly prohibited from engaging in any
activity that compromises the security of the Snapcar platform. This includes, but is not
limited to, the following:
Prohibited Actions:
- Accessing or attempting to access data or user accounts not intended for you,
including unauthorized login attempts to any part of the platform or its servers.
- Probing, scanning, or testing the platform or network for vulnerabilities without
express authorization.
- Bypassing or attempting to bypass security or authentication measures.
- Disrupting or interfering with platform operations, including activities such as
introducing malware, viruses, overloading the system, flooding, spamming, or
launching denial -of-service (DoS) attacks.
- Sending unsolicited messages , emails, or promotional content through or using the
platform.
- Manipulating headers, forging email identifiers, or masking sender identity in any
communication or post made via or in connection with the platform.
Such activities are considered unauthorized and unlawful , and may result in civil or
criminal
liability under applicable Indian laws.
Monitoring and Enforcement
Snapcar reserves the right to:
- Investigate any suspected security breach , misuse, or violation of platform rules.
- Cooperate with law enforcement authorities in prosecuting Users involved in illegal
or malicious activities.
- Take technical or legal action (including suspension or termination of user accounts)
against anyone found to be compromising platform security.
Use of Automated Tools
You agree not to use any unauthorized tools, bots, crawlers, or automated scripts to:
- Access, index, or collect information from the Snapcar platform.
- Perform repetitive or malicious actions that disrupt normal user experience.
Only standard, third -party browsers (e.g., Google Chrome, Safari, Microsoft Edge) and
platform -provided tools are permitted for accessing or using the Snapcar website and app.
By using Snapcar , you acknowledge and agree to comply with these security obligations. Any
violation may lead to account suspension, legal action , and full cooperation with regulatory
authorities.
Severability
If any provision of this Agreement, or any related policy or document referenced herein, is
found to be invalid, illegal, or unenforceable under applicable law or by any arbitral tribunal
or court of competent jurisdiction, such provision shall be considered severed from the
Agreement.
The invalid or unenforceable portion shall be replaced with a valid and enforceable
provision that most closely reflects the original intent of the affected clause.
The remainder of this Agreement shall remain in full force and effect and enforceable to the
maximum extent permitted by law.
Entire Agreement
Unless explicitly stated otherwise, this Agreement —together with the User Terms , Platform
Policies , Fee Policy , and other documents or terms referenced herein —constitutes the
entire agreement between you (the User) and Snapcar Technologies Private Limited with
respect to your use of the Snapcar platform and services.
This Agreement supersedes all prior communications or understandings , whether oral,
written, or electronic, related to your use of the platform and any bookings made thereon.
Waiver
If Snapcar chooses not to enforce any provision of this Agreement at any point in time, such
inaction shall not be considered a waiver of Snapcar ’ rights to enforce the same provision at
a later time.
Likewise, any waiver by Snapcar of any specific breach shall not be deemed a waiver of the
provision itself , or of any subsequent breach of the same or different nature.
Assignment
Users (Guests) may not assign or transfer this Agreement, in whole or in part, or any rights
or obligations hereunder, without the prior written consent of Snapcar .
Such consent may be granted or withheld at the sole discretion of Snapcar .
Snapcar , however, reserves the right to assign or transfer this Agreement, or any of its rights
or obligations, in whole or in part, to any affiliate, partner, or successor entity without
requiring prior notice or consent from the User.
In such cases, Users agree to continue fulfilling
all obligations under this Agreement with
respect to the new assignee.
Force Majeure – Snapcar
The performance of obligations under this Agreement, including those related to bookings,
payments, support services, or third -party integrations (e.g., payment gateways,
communication tools, or logistics providers), may be impacted by Force Majeure Events .
A “Force Majeure Event ” refers to any circumstance beyond the reasonable control of
Snapcar , the User, or any involved third -party service provider, which could not have been
prevented through reasonable care or diligence. These may include, but are not limited to:
- Natural disasters (e.g., floods, earthquakes, storms, lightning)
- Pandemics, epidemics, lockdowns, and public health emergencies
- War, terrorism, revolutions, blockades, riots, or civil commotion
- Strikes, labor disputes, or shortage of essential services
- Utility outages, communication breakdowns, or cyber disruptions
- Governmental restrictions, new laws, regulations, or court orders
In the event of a Force Majeure Event, Snapcar shall be excused from performance of the
affected obligations for the duration of the disruption .
If such an event continues for more than 60 (sixty) days , either party may terminate the
Agreement by providing written notice.
Events that could have been reasonably mitigated through due diligence or backup systems
will not be considered Force Majeure .
General Provisions
- Nothing in this Agreement shall be construed as creating a partnership, joint
venture, or agency relationship between Snapcar and the User (Guest), or between
Snapcar and any Vendor (Host).
- Snapcar acts solely as a technology platform provider , facilitating interactions
between independent Users and vehicle owners.

- Snapcar is not liable for any breach or misuse by third parties outside the scope of
their agreement.
- If you choose to share your information with a third -party platform or service (even

User Responsibility

- Logging out from shared devices

Snapcar will not be held responsible for any loss, misuse, or unauthorized disclosure of
personal data resulting from circumstances beyond our reasonable control, including but

- Fire, flood, earthquakes, or natural disasters
- Cyberattacks, hacking, or power failure
- Riots, industrial actions, wars, or governmental restrictions
- Major system failures or third -party infrastructure compromise

Account Deletion
You may permanently delete your account at any time via the Snapcar mobile app:
- 1. Open the app and go to the Profile tab .
- 2. Navigate to Settings .
- 3. Select the “Delete Account” option and follow the instructions.
Please note:
- If you’ve posted reviews, feedback, or ratings, some of that content may still remain
visible in cached pages or archives or may have been accessed by other users prior to
deletion.
- Deleting your account does not automatically erase all data , as certain records may
need to be retained under legal, tax, or audit requirements.
Your Consent
By creating an account or providing personal information on the Snapcar platform, you
voluntarily consent to:
- The collection, processing, and use of your personal data in accordance with this

- Verification of your identity using government -issued photo identification , which
may include your driver’s license or other address -bearing documents.

Snapcar Guest Fee Policy

This Guest Fee Policy outlines all applicable charges, refund conditions, and booking -related
terms for Guests who book self -drive vehicles through the Snapcar Platform. Snapcar is a
technology platform that connects users ("Guests") with registered vehicle owners ("Hosts").
We do not charge any commission, provide insurance/protection plans, or collect any
deposit other than the fixed token amount paid during booking.
Lease Rental Fee
- Guests are required to pay a token amount through the Snapcar platform to confirm
the booking.
- The balance Lease Rental amount is payable directly to the Host at the time of
vehicle handover.
- The Lease Rental is determined by the Host and is based on factors such as booking
duration, vehicle type, location, and timing etc.
Token Payment (Advance Amount)
- This token amount confirms your booking and is non-refundable if cancelled within
24 hours of the trip start time.
- The token is transferred to the Host after successful trip completion , following a
brief verification process.
- No deposit or damage protection coverage is collected by Snapcar .
Cancellations by Guest
- 0–24 hours before trip start: No refund of token amount.
- More than 24 hours before trip start: 100% of the token amount will be refunded.
- After trip start: No refund is applicable.
Snapcar may withhold a refund in cases where fraudulent or repeated booking abuse is
suspected.
Vehicle Damages, Misuse & Responsibility
- Snapcar does not offer Trip Protection Plans .
- Guests are directly liable to the Host for any damages, accidents, or misuse of the
vehicle during the trip.
- Any dispute regarding damage costs must be resolved between the Guest and Host.
Snapcar will only assist as a neutral intermediary if reported via the app.
- Direct cash settlements are not encouraged. All payments should be traceable (UPI,
bank transfer, etc.).
No-Show Policy
If the Guest fails to show up or collect the vehicle within the scheduled trip , the booking will
be cancelled, and the token amount will be forfeited.
Late Returns
- Guests returning the vehicle later than the scheduled drop -off time may be charged
an hourly late fee by the Host.
- This fee must be paid directly to the Host at the time of return or via digital transfer.
Fuel, FASTag & Tolls
- Guests are expected to return the vehicle with the same fuel level as at the time of
pickup.
- In case of less fuel, Hosts may charge the Guest at actual fuel cost.
- FASTag or toll charges incurred during the trip are the responsibility of the Guest and
must be paid to the Host.
- Snapcar is not involved in resolving fuel or toll disputes.
Home & Airport Delivery (If Offered by Host)
- Charges for doorstep or airport delivery are set by the Host.
- If the Host cancels delivery, Guests are entitled to a full refund of any delivery fee
collected.
- If only one leg (pickup or drop) is cancelled, 50% of the fee will be refunded.
Dispute Resolution
- Guests may raise a dispute within 7 days of booking completion via:
- The Help section in the Snapcar app
- Email: support@ Snapcar .com (include Booking ID and concern)
Our team will coordinate with the Host and respond within a reasonable time frame.
Important Reminders
- All payments must be made digitally and documented.
- Snapcar does not offer damage coverage, insurance, or collect security deposits.
- Guests are responsible for:
- Ensuring the car is compliant and in good condition before the trip (report
any issues via app)
- Driving lawfully and returning the vehicle on time and in acceptable condition
- Communicating respectfully with Hosts and reporting any misconduct or
disputes
Final Notes
Snapcar may revise this Guest Fee Policy at any time. Updates will be communicated via
email or app notifications. Continued use of the platform confirms acceptance of the
revised
terms.
